Smith：Mr. Lee, the September consignment arrived at our port was seriously damaged.More than 15 percent of the glass arts and crafts were broken.

史密斯：李先生，贵方9月份到达我方港口的那批货物严重受损。15%以上的玻璃工艺品都破损了。

Mr. Lee:It's impossible. Our goods are well-examined before shipping.

李先生：不可能。货物在装运前我们都严格检验过的。

Smith:Maybe the losses occurred in transit. Since we concluded this business on CIF basis,I have to claim with you for the losses.

史密斯：也许破损是在运输过程中发生的。我们这单生意是以CIF到岸价格条件成交的，这次损失我们只好向贵方提出索赔要求了。

Mr. Lee:Sorry, we cannot pay your claim. It is not our fault. We are not liable for the damage. Owing to the Risk of Breakage is not mentioned in the contract, the losses are not covered by your insurances.

李先生：很抱歉，我们不能接受您的索赔要求。这不是我们的过错，我们没有义务对此负责任。合同上并未提及破碎险，这个损失不在你们投保的险种之内。

Smith:Then whom should we claim with, the insurance company or the shipping company?

史密斯：那我们该向谁索赔呢，是保险公司还是运输公司？

Mr. Lee:We suggest that you deal with the insurance company and the shipping company. If you had insured against breakage, it is clearly a case for the insurance company.You can file the claim with the insurance company.

李先生：我们建议你们与运输公司和保险公司联系。如果你们投保了破碎险的话，这显然是保险公司的责任。你可以向保险公司索赔。
